裁判文书实名上网之隐忧与对策

顺应司法改革潮流，完善司法制度，2014年1月1日起，我国将实行裁判文书上网制度，这是一项裁判公开完善的重要制度。文章指出，该制度的设计存在着一些问题，裁判文书实名上网，是否会为公众带来困扰，是否会架空诉讼？这些都令人担忧。笔者对该制度的设计背景进行研究，并分析该制度设计的目的，考察国内外相关制度的规定，旨在对我国裁判文书上网制度存在的问题予以修正。

Problems and Countermeasures in the Publicity of Real Name Judgement Documents

Conforming to the trend of judicial reform and perfecting judicial system, the publicity of real name judgement documents was carried into effect in January 1,2014. This is a very important system to perfect publicity of trial system. The design of this system has some problems. Real name on the Internet will bring trouble to the public, also leave trial unused. The writer study the background of the system and the purpose of the system , then investigate legal provisions of other countries and areas and give some suggestions to correct our own systerm at the end.
