| 摘 要： | 在宪法与宪政的关系上,保障人权的目的使二者获得了一致性规定。不过宪法和宪政并不总是一致的,而是背离和互动并存,有宪法无宪政以及有宪政无宪法的情形都有其历史原型。要开启宪法与宪政的互动之门,就必须强化宪法作为根本法的权威,并使宪法成为真正的"法"。

| Abstract: | To protect human rights is tie shared task of constitution and constitutionalism. The framework of limited government is designed by constitution, and its main manifestation is constitutionalism. But it isn＇ t always consistent the relationship between the constitution and constitutional government, there is often a constitution without constitutionalism and a constitutional government without constitution. |
