| 摘 要： | 中国律师制度的产生和发展历程较为曲折,近现代律师职业及律师制度是在西方法律文化的介入和影响下渐变而来的,而期间又经历了国内诸多历史、政治变迁的影响。律师制度直接体现了国家的文明发展水平和法制化程度。律师在我国执业刑事诉讼的困境的原因是多方面的,如果不妥善解决律师执业所面临的问题,将对律师职业的发展,乃至国家法治的实现造成现实的障碍。

| Abstract: | The formation and development of lawyer system in China is complicated. It has been formed with the introduction and interference of Western law culture, while experiencing the influences of domestic historical and political changes. The lawyer system directly reflects civilization standard and legal system degree of a country. A lawyer's predicament when he is engaging in criminal litigate in our country has various reasons and needs to be handled carefully and skillfully, or it may be a realistic obstacle for the development of lawyers' career and realization of rule of law. |
