行政协调的现实与规范

尽管在行政法学的视野中,行政协调属于内部行政方式,但确立法治主义的行政协调原则,从规范分析进路提出行政协调规范依据,坚持职权法定、程序公正、民主协商、整体政府诸原则已成时代之需。为提高行政协调运行实效,在工作机制与内部程序上亦提出具体建议:完善部门联席会议机制,优化议事协调机制,建立部门信息数据共享机制,开发利用在线协调机制,适时引入第三方参与机制,以促进行政协调良性发展。

. Administrative Coordination Types and Regulations

Though administrative coordination is an internal administrative way from the perspective of administrative law, it is necessary to establish the principle of administrative coordination based on rule of law. In normative analysis, the legal standard of administrative coordination should be brought forward and the principles of statutory authority, procedural justice, democratic consultation and the whole government should be followed. In order to improve the effectiveness of administrative coordination, specific suggestions are also put forward, that is, to improve the mechanism of departmental joint meetings, to optimize the discussion and coordination mechanism, to establish a mechanism for sharing departmental information and data, to develop and utilize online coordination mechanisms, and introduce third-party participation mechanisms at appropriate times.
