中国私有财产权宪法保障价值取向之定位

本以西方国家私有财产权保障模式的价值取向演绎为切入点，指出各国的进程并没有统一的阶段性规定，私有财产和社会利益一直处于一种劝态的平衡之中，是不同历史阶段的选择。我国现阶段近代国家的历史课题远没有彻底完成，同时须完成现代国家的任务，因此我国建立以“近代”为基础，兼有“现代”特征的私有财产权保障模式，是我国现阶段历史课题的必然。

The essey dicvuises that different countries do not follow the same historic process according to the value tendancy derelopement of private property insurance pattern in the west. The private property dlways keeps in dynamic equilibrium with social benefits. They are the results of different historic stages. Until now we still hare not fulfill the research on modern world history. In the meanwhile, the research on contemporary wolld history should be tackled. Therefore,in the subject of the history,we should construot the private property insurance pattern on the basis of the modern history, which also featares the contemporary history.
