| 摘 要： | 相比《物权法》的相关规定，《物业管理条例》在理念上存在两个重大偏差。首先，在物业管理的问题上否认了业主自治，不允许业主管理自己的物业，要求必须聘任物业服务企业。其次，强调政府通过行政权力“划分”物业管理区域，而不是根据业主的财产权“确认”物业管理区域。正是由于这些问题的存在，《物业管理条例》的相关制度与《物权法》存在冲突，需要在新的理念指导下重新设计。
