《物业管理条例》的理念偏差与制度缺陷

摘    要:相比《物权法》的相关规定,《物业管理条例》在理念上存在两个重大偏差。首先,在物业管理的问题上否认了业主自治,不允许业主管理自己的物业,要求必须聘任物业服务企业。其次,强调政府通过行政权力“划分”物业管理区域,而不是根据业主的财产权“确认”物业管理区域。正是由于这些问题的存在,《物业管理条例》的相关制度与《物权法》存在冲突,需要在新的理念指导下重新设计。
