认真对待少数人权利——人权话语下的考量

25年前,美国著名法学家德沃金就提出了"认真对待权利"的命题;25年后,权利问题仍然是我们这个时代所必须认真对待的大问题与真问题。少数人作为弱势群体的一部分,其权利日益受到各国的关注与重视。但是由于理论上的缺失和实践上的背离,少数人权利的保护仍然面临困境。基于人权的普遍性和平等理论,认真对待少数人权具有必然性和正当性。

Taking the Rights of Minority Seriously: Angle of Human Rights

25 years ago,the famous American jurist Dworkin raised the proposition that treat rights seriously.And now,in this era,the problem of rights is still a big and genuine problem that we must treat it seriously.The "minority" group,as a part of the disadvantaged,their rights catches more and more attention increasingly.However,due to lacking of theory and the departure between practice and theory,the protection to minority rights still face difficulties.However,based on the universality of human rights and the theory of equality,deal with the "minority's rights" seriously is inevitable.
