| 摘 要： | 电子商务的快速发展与相应立法的滞后 ,使确认电子合同的法律效力问题成为确保交易安全的关键所在。如何充分运用我国现行的法律 ,解决关于电子商务合同主体、签章、资讯安全及其法律责任的承担问题 ,是解决立法滞后阻碍电子合同健康发展、确保新经济有序发展的重要条件。

| Abstract: | The contradiction between the rapid development of electronic commerce and the stagnation of corresponding legislation makes the validating of the legal effect of electronic contract become the key issue of ensuring the safety of trade. How to fully use our country's decrees in effect to solve the problems concerning the main body, the seal and/or the signature, the safety of capital information and the undertaking of legal responsibility of electronic commercial contract is a presupposition of resolving the problem caused by the stagnation of legislation that hinders the steady development of electronic contract so as to ensure the condition of orderly development of new economy. |
