| 摘 要： | 知识产权中的著作权、专利权和商标权的客体多要求采用一定形式公开，因而，上述知识产权法律保护主要借助或者依靠公力，商业秘密的保护主要依靠私力，具有保护时间长和节省社会成本的特点。商业秘密的不公开使用和核心信息的不易破解性决定了商业秘密保护的特点，本文主要对商业秘密的不易破解性进行分析从而使对于商业秘密的保护从私力和公力两个角度进一步加强和完善，以促进民族产业和民族企业的发展。

| Abstract: | The objects of copyright, patent and trademark rights in the intellectual property adopt some open form. Thus, the legal protection of intellectual property relies mainly on the support of the public power and commercial secrets reckon mainly on the protec- tion of private power with many characteristics,such as long time＇ s protection and social costs＇ savings. Commercial secrets are used privately and core information is difficult to resolve determine the characteristics of the protection of commercial secrets. This paper mainly analyzes the not - easy - to - explain nature of commercial secrets. Then, from two angles of the public and private powers the protection of commercial secrets is further strengthened and improved in order to promote the development of national industries and enterprises. |
