论罢工权应该缓行

摘    要:罢工权设置方式的选择是一个价值评价问题,只能从其价值实体即罢工和价值标准即社会的需要、目的两个方面来考察。价值标准是个历史范畴,受到生产力发展水平、工会的独立性、配套法规的完善、劳动者的罢工意识等因素的影响,在不同历史时期、不同的历史条件下价值标准有不同的内容。在我国当前将罢工上升为法定权利的条件尚未成熟的情况下,盲目地从西方国家移植罢工权制度,与我国当前的实际不相符合,罢工权应该缓行。

Abstract:The selection to set up the right to hold strike is an issue of value evaluation, which can only be assessed in two aspects: (1) value substance, that is strike; (2) value standard, that is social demand and objective. The standard of value is of a historical category, which has distinct contents in dissimilar historic periods and different historic circumstances, and it is affected by such factors as development level of regulations, strike consciousness of laborers. Currently the conditions have not yet been mature for upgrading strike to a Legal Right in our country. In such case, transplanting rashly the institution of right to strike from the West is not in conformity to the reality of our country. Therefore, setting up a legal right to strike should be postponed.
