| 摘 要： | 法官的自由裁量权是一种司法权力，但在实质上却是一种伦理裁判权。在特定的政治体制和法律体制下，法官会面临着诸如事实认知、规范选择、组织人的伦理自主丧失等种种伦理困境。应当将法官的伦理自主确立为法官自由裁量权走出伦理困境的基本策略，并设计法官自由裁量权的科学合理的制度伦理机制。

| Abstract: | The judicial discretion is a judicial power, but in essence it is a kind of moral jurisdiction. Under the particular political system and legal system, the judge faces ethical dilemmas such as the fact of cognitive, normative choice, the organization's ethical autonomy of the loss,etc. Ethical autonomy for judges should be established as the basic strategy of the judicial discretion to design the the scientific and rational system of ethics mechanism. |
