罚金刑功能论

在对刑罚的功能进行分析的基础上,认为罚金刑的功能是:惩罚,对犯罪人的惩戒和谴责;剥夺,对犯罪人的金钱的刑事剥夺;威慑,对犯罪人和潜在犯罪人的慑止;鉴别,帮助认识罪与非罪的界限,提高法制观念;安抚,满足要求惩罚犯罪的强烈愿望,平息犯罪造成的激愤情绪,慰藉精神创伤;鼓励,强化和促进守法者守法和鼓励跟犯罪做斗争;感化,消除犯罪人的敌对情绪,使其成为有利于社会的人;补偿,补偿犯罪造成的损失与损害,恢复或重申维持社会存在的基本秩序与价值观念。

Based on the analysis of the function of penalty,the author thinks the function of fine penalty is: punishment,to condemn and punish the criminal;deprivation,criminal depriving the criminal of money;deterrent, deterrent to the criminal and the latent criminal;distinction,to help people know differences between crime and non-crime,and enhance people's conception of legality;comfort,to satisfy the intense desire to punish the criminal,to subside indignant mood created by crimes,and to console the victims of crime;encouragment,to strengthen and promote people to obey the law,to encourage people to struggle against crimes;influence,to eliminate hostile feeling of the criminal and cause them to be people who is advantageous to society;compensation,to compensate for the loss and harm made by crimes,to restore or reiterate the basic order and value idea which can make the society continue.
