从“言据性”看证据的符号性质

本文所提出符号学的证据观,认为证据学的研究任务不是证据背后的事实本身,而是考察证据的符号性问题,即证据与事实之间复杂的不对应关系。通过对语言学＂言据性＂研究成果的分析,肯定了该研究对证据符号学的理论价值。借助于阐发＂言据性＂所体现的证据符号学内涵,本文进一步指出：证据仅仅是一种真实关联度,即：证据不是事实,而是形成事实的符号化方式和逼进事实的过程。

A Study on the Semiotic Nature of Evidence from the Perspective of Evidentiality
