外国公职人员行贿罪探究

"对外国公职人员、国际公共组织官员行贿罪"的增加从打击日渐猖獗的国际商业贿赂犯罪方面极具合理性。对外国公职人员行贿罪的研究是针对我国刑法体系中行贿罪研究的缺失而提出的。通过对外国公职人员行贿罪入刑的合理性以及在本罪的认定过程中可能出现的一些问题进行全方位的探讨。进一步分析研究我国关于此罪规定方面的不足和缺陷,针对种种的不足和缺陷提出一些改进建议。使得本罪的相关规定更加的完善,整个刑罚体系与国际接轨,与时俱进。

Research on the Crime of Bribery of Foreign Public Officials

The article ＂ The crime of bribing the foreign public officials and officials of public international organizations＂ is beneficial to crack bribery in international commerce. Study on bribing foreign officials contraposes the lack of China＇s criminal law system of bribery. This paper focuses on the problems in affirming bribery and complementing punishment for bribing foreign public officials, and further analyzes the deficiencies and shortcomings of this crime regulations in our country. Suggestions are put forward correspondingly to perfect the relevant regulations and integrate with the international penal system.
