社会法治国下的国家形象与国家任务

社会法治国是法治国原则和社会国原则相互作用的产物,其主要强调国家对人民的积极给付义务。通过梳理社会法治国的发展历程,回顾国家在各个历史发展时期的不同形象、任务及其不完善之处,从而推导出国家在社会法治国的框架下应当具有的新任务,即社会分配和社会发展两个面向。参照中国的现实,当从国家形象的塑造和国家任务的完成两方面进行着手,完成社会法治国对国家的要求。

National Images and National Missions under Social State of Rule of Law

Social state of rule of law is the product of the interaction between the principle of rule of law and the principle of social state, whose main emphasis is on the national positive obligation to the people. By combing the course of devel- opment of the social state of rule of law, the paper recalls the different images, tasks and imperfections of countries in va- rious historical periods to derive new national tasks in the framework of the social state of rule of law, namely social distribution and social development. It concludes it is necessary to satisfy the requirements of social state of rule of law to the countries in constructing the national images and accomplishing the national missions by referring to Chin＇s reality.
