| 摘 要： | 有组织犯罪具有从低级形态不断向高级形态演进的自主趋势.要想有效遏制有组织犯罪的发展壮大,就必须以有组织犯罪的演变规律及其在本土的具体表现为基本事实依据.本文以近5年来河南、湖南两省终审审结的362个有组织犯罪案件、4994名涉案人员作为样本,运用实证研究方法进行定性和定量分析,从组织结构、行为方式、资金状况、人员构成等角度出发,揭示出我国当前有组织犯罪的发展规律.

| Abstract: | Organized crimes evolve from lower to upper forms. In order to effectively fight the development and expansion of organized crimes, we must choose the development regularities of organized crimes and their local features as the basic facts. The authors made an empirical research from the sample of 362 organized crime cases and 4994 involved defendants from Henan and Hunan Province in past 5 years, to reveal the current development regularities of Chinese organized crimes in aspects of organizational structure, criminal Conducts, capital position and members of the organization. |
