大学章程:秩序规则的二元性———一种历史角度的考察倡

大学章程体现了大学内部治理规则,是我国大学治理中引进的西方舶来品.引进大学章程的目的是既要解决我国大学“一管就死,一放就乱”的现状,又要使其为现代大学制度的建立保驾护航.通过考察西方大学章程内容后可以发现,作为大学自治传统载体的大学章程体现出了秩序规则的二元性,其内生秩序决定了大学的本质,也成为其事业发展和传承的核心,其内化的秩序规则体现了大学与外部世界之间的关系,反映了大学在社会中的地位.内生秩序规则与内化秩序规则的变化对应了大学发展过程中经历的兴衰,而历史的经验将对我国大学章程建设具有重要的启示意义

Dual Regular System of the Constitution of University:A Historical Perspective

Introduced from western countries,the constitution of university reflects university’s internal governance.The purpose of establishing constitution of university in our country is not only to solve the difficult situation that "tightening control results in stiffness while relaxing control brings about disorder",but also to escort modern university system.By analyzing the constitution of university in western countries we find that,as a carrier of the tradition of autonomy,the constitution of university reflects the duality of regular system.The regular system which grows from inside decides the essence of university,and becomes the core of its development and inheritance.The regular system which grows from outside reflects the relationship between university and its external environment,and the status university occupies in the society.The change of the dual regular system corresponds to the rise and fall of university through history.The historical experience will provide insights for constructing the constitution of university in our country.
