法的起源探源--再论马克思主义的法起源观

法的起源是法学研究的一个根本性问题.本文从分析法的概念和本质以及法与法律的区别入手来探讨法的起源问题,在此基础上来分析和论述法的起源.随后指出"法起源于国家"这一认识是对真正马克思主义关于法的起源学说的误解和歪曲,是完全错误的.在此基础上,本文得出了法起源于原始母系氏族社会、原始社会规范的出现和原始习惯的产生是法产生的标志的结论.

Primary Studies on the Origin of Law--Rethinking of the Marxist View on the Origin of Law

The origin of law is a fundamental issue for studies on law.This article discusses it by analyzing the concept of law and the essence of law and by distinguishing the differences between "law"(Jus) and" a law for laws"(Lex).The paper also points out that the argument that law originates from state is the result of misinterpreting and distorting Marxist view about the issue and therefore,it is completely wrong.On this basis,the paper draws the conclusions that law originates in the primitive matriarchy society and and that the start of custom or conduct norm in primitive society signs the beginning of law.
