宪法下的行政职权：行政法学的逻辑起点

行政法学的研究离不开其逻辑起点的分析,而行政法学的逻辑起点分析,需要其逻辑原点作为哲理基础,但哲理基础的研究又是建立在对人性的探讨基础之上。人的自由意志本质是行政法的人性基础,自由意志的自在自为活动构成法律上的权利,这种法律上的权利首先表现为人格权,再由人格权的延续与扩展形成身份权和财产权。行政权力是公民人格权以契约的形式聚合而形成,公民权利和宪法下的行政职权分别构成行政法的逻辑原点和逻辑起点。

Administrative Power Within the Purview of Constitution: The Logical Starting Point of Administrative Law

The study of administrative law can't be conducted without the analysis of its logical starting point,which is based on its philosophy of the research of human beings.Man's will,an inborn right,in its essence is the premise of administrative law.Such kind of right granted by law is called personal right;thereafter appearing others forms of rights such as identity,property,etc.Administrative power is formed in the way of citizens' contracts.Therefore,freemen' right and administrative power within the purview of Constitution are respectively the logical origin and starting point of administrative law.
