关于建立我国简易破产制度的思考

简易破产制度是西方国家破产法中的一项重要制度。对于提高案件审理效率、降低破产成本发挥了重要作用。我国目前虽然还没有相关规定,但从公正和效率的原则出发,我国无疑亦应建立自己的简易破产制度。文章首先阐述了简易破产制度的含义及基本内容,分析了一些国家有关简易破产制度的规定,指出了建立我国简易破产制度的基本思路。

Reflection on Building Our Simple Bankrupt Institution

The simple bankrupt institution is an important institution of bankrupt law in west countries .It plays an important part in raising efficiency of hearing a case,and dropping bankrupt cost. Though having no interrelated provision, based on fair and efficient principle,our country should build simple bankrupt institution .By explaining the meaning of simple bankrupt law and its content and analysing the interrelated provision of other countries ,this paper points out the basic thinking to establish simple bankrupt institution in our country.
