捐赠关系中的受赠主体研究

捐赠法律关系中的受赠主体是一个极为重要的角色。受赠主体作为一种社会法律现象，通过网络募捐、短信募捐、校园募捐等多种形式表现出来。涉及受赠主体的诸种现象中，有的受赠主体是法律明确规定的，有合法性基础，而有的受赠主体则不是法律规定的受赠主体，没有合法性基础。我国慈善事业发展迅速，现行的捐赠立法不能适应当前社会发展的要求，我国现阶段，应当借鉴国外相关立法经验或成果，整个捐赠关系应紧紧围绕受赠主体，从主体范围、捐赠强制到财产监管等，都须进行制度化的规范与运作，完善我国捐赠立法。

Research on the Recipient in the Relation of Donations

The recipient plays an extremely important role in the relation of legal donations.The recipient,as a social legal phenomenon,is manifested through the network whip-round,messages whip-round,campus whip-round and other forms.Some recipients are defined clearly by the law,based on legitimacy,while others are not the ones defined by the law,without the legal foundation.China's charity develops so rapidly that the existing legislation can not meet the need of the society.China should learn from foreign countries' experience or the outcome of the relevant legislation.The entire donation should focus on the recipient;the scope of the recipient,donation compulsion,property supervision and so on must be operated according to the regulation;and the legislation of China's donation must be perfected.
