论物权关系中的诚信原则

诚信原则应该包括主观诚信和客观诚信。主观诚信是行为主体对自己以及与其相关的相对人行为符合法律或具有合道德内容的个人确信或信赖。客观诚信就是要求主体依法行事。诚信原则对物权关系中的物权行为制度、公示公信原则、善意取得制度和占有制度都起到了指导作用。

The principle of good faith should include subjective good faith and objective good faith.Subjective good faith is the individual confidence or trust,which the actor thinks that his and the relative's behavior is legitimate or moral.Objective good faith require that the actor acts according to law.The principle of good faith has played a guiding role in the juristical act of real right,the principle of disclosure and trust,the system of acquisition in good faith and the system of possession in real right.
