试论国际组织的国际法律人格及其与国家的关系

国际组织在国际秩序中的作用基于国际组织的国际法律人格。国际法律人格取决于设立条约的规定。就国际组织与成员国的对内关系而言,成员国应服从国际组织作出的决定。国际组织与国家包括非成员国的对外关系是一般国际法上的平等主体的关系。国际组织的客观国际法律人格也体现在国际组织与非成员国的关系上。

The Legal Personalities of International Institutions and Their Relations with Other Nations

The roles of international institutions in the world order are based on their international personalities.The issue of this kind of personality will in the first instance depend on the terms of the basic treaties of inter-national institutions. As for the relation between the international institutions and the internal affairs within themember states, the member states will follow the decisions made by international institutions. The relationbetween the international institutions and the external affairs of the member states and non-member states isequal under the general international laws. Of course, the objective international legal personalities of the in-ternational institutions are made clear in the light of the relations between the international institutions and thenon-member states.
