论社会分工对现代人性的型塑

作为制度根据的人性为社会分工所规定,所以,分析社会分工所型塑的人性结构的历时性与普遍性具有重要的意义。而发达的社会分工及其社会结构——公域与私域决定了现实的人性结构是:个人意识与集体意识的中道平衡;人的自利心与利他心的中道平衡;个人利益与共同利益的中道平衡;自由与秩序的中道平衡。因此,从人性的角度看,我国和谐社会建设的关键在于:在正当程序中实现多元价值的中道平衡——追求价值的程序论证为法治之要。
