| 摘 要： | 我国证券市场上虚假陈述、内幕交易、操纵市场等违法违规行为损害股民利益的现象屡见不鲜,而股民受损利益往往又很难得到救济,究其原因在证券民事赔偿诉讼中没有设立恰当的诉讼人代表制度是原因之一。本文从各国群体诉讼模式的立法例入手,探讨了我国证券民事赔偿中的诉讼代表人制度的完善。

| Abstract: | The phenomenon that such unlawful practices as the false stating , insider trading, market manipulation,etc. are harmful to interests of stock owner is of common occurrence on the security market of our country, and stock owner's damaged interests are often very difficult to be relieved, one of its reasons is that we have not set up appropriate lawsuit systems of representative action in the civil compensation lawsuit of the securities. This text proceeds with legislative example of class action modes of various countries and has probed into the perfection of the system of representative action in the civil compensation of securities of our country. |
