| 摘 要： | 人体器官移植由人体器官植入行为和人体器官摘取行为构成.其中人体器官植入行为属于传统医疗行为范畴,适用医疗服务合同法理;人体器官摘取行为则仅是医疗援助行为,但因存在合理的受害人同意而阻却了其违法性,在适用上可准用医疗服务合同法理. |

| Abstract: | This article suggests that the human organ transplantation is comprised of the transplantation action and the removal action. The transplantation is a matter of therapeutic action, and can be complied with the medical service contract, while the removal is only helpful for therapeutic actions, which should be legally exempted from law responsibility because of victim's reasonably informed consent. |
