提升行政相对人之法律地位略论

现代公共行政的发展与服务行政观念的确立已使行政法学界较多地关注行政相对人的法律地位问题。传统理论过分注重行政主体的法律地位,轻视行政相对人在行政法律关系中的地位和作用,使得行政法律关系以直接管理为主导,不利于调动行政相对人参与行政活动的主动性和积极性,不利于行政法朝着文明、民主及科学的方向发展。得益于行政法理论的进步和行政活动实践的发展,试就行政相对人法律地位提升问题作一阐释。

Simply Study on the Legal Status Promotion of the Administrative Relative Person

The development of modern public administration and establishment of administrative idea of service have already made the scholars of the administrative law circle pay more close attention to the issue of legal status of the administrative relative person.The traditional theory paid excessive attentions to the legal status of administrative subject,and in the meanwhile despised relative people's status and function in the administrative legal relations of administration,which made the administrative legal relations take direct management as the leading factor,so it is unfavorable to stimulate initiative and enthusiasm that the relative person of the administrative participate in the administrative activities and make the administrative law develop in the civilization,democratic and scientific direction.Benefited from the progress of the administrative law theory and development of administrative activities,this article tries putting forth effort to explain on the issue of promoting the legal status of administrative relative person.
