制定反垄断法的几点思考

经济全球化进程的加快要求我国尽快制定反垄断法,对市场竞争领域的有关问题做出规定。经济全球化背景下我国制定反垄断法,应该以统筹国内发展和对外开放为指导思想;反垄断法中应当对行政性垄断进行规制,但不应将其作为重点,重点应在经济性垄断;对知识产权领域限制竞争行为的规制作出一般性规定,并在一定程度上确认反垄断法的域外适用效力;在全国设置统一的专门的反垄断执法机构。

Considerations in Formulating Anti-monopoly Law

The acceleration of economic globalization requires the formulation of the anti-monopoly law.China's anti-monopoly law aims at developing domestic economy and pursuing the policy of opening to the outside world.The anti-monopoly law should include the regulations of executive monopoly and economic monopoly,but the emphasis should be put on the latter.The law should regulate the limitation of the competition about the intellectual property and apply to other countries.We should found universal anti-monopoly agency throughout the country.
