关于婚姻效力立法的思考

婚姻的有效与无效是建立在婚姻成立的基础上，由于我国婚姻法未能区分婚姻的成立要件与婚姻的有效要件，以致关于婚姻效力的立法存在着不少缺陷，尤其是关于无效婚姻制度的立法。一些人把事实婚姻、无效婚姻和可撤销婚姻等理解为不存在婚姻关系，当事人一方再行同他人结婚亦不构成重婚。实质上，这种说法混淆了婚姻的成立与婚姻的有效。为此，我们有必要对婚姻的效力制度进一步完善，严格区分无效婚姻和无婚，完善我国的无效婚姻制度。

Thinking of the Legislation on Marriage's Efficacy

Whether the marriage is effective or not based on the marriage established,because the "marriage law" fails to distinguish the effective documents and the building documents of marriage and mang defects existed in the legislation on marriage's efficacy,especially the legislation about the void marriage system.It is necessary to examine the system of void marriage so that we can offer the suggestion consulted for perfecting the marriage law.
