在经济全球化的背景下,建立一个公平竞争的国际经济秩序,促进人类的共同繁荣,是建立国际经济新秩序的重要课题.在这一问题上,发达国家和发展中国家存在着根本的分歧.发展中国家要落实平等发展的权利,打破发达国家及跨国公司对市场和技术的垄断,对本国民族经济给以更多优惠和保护安排.而发达国家则以国际反垄断来控制跨国公司"非国家化"和"非中心化"倾向,维持本国经济的竞争优势,打压新兴市场国家日益提高的国际竞争力.因此,今后在建立国际经济新秩序中,发展中国家将面临严峻挑战.

Economic Globalization and the Law of International Anti-Trust:New Challenges Confronting Developing Countries in building a New International Economic Order

In the context of economic globalization, establishing an international economic order on the basis of fair competition with a view to bringing about prosperity for all human beings is an inevitable task of building a new international economic order. On this issue, serious disagreements exist between developed and developing countries. Developing countries demand that equal rights for development be guaranteed, that monopolization of technology by developed countries and transnational corporations be broken down, and that more preferential and protective policies be provided for the development of national economy. Developed countries prefer to use international anti-trust to control the process of decentralization and denationalization by transnational corporations so as to maintain their economic advantage for competition and to weaken the increasing strength of the newly emergent market-oriented developing countries for international competition. Developing countries, therefore, are yet to face serious challenges in the struggle of building a new international economic order.
