| 摘 要： | 禁止权利滥用原则是对权利行使的合理和适度限制；禁止权利滥用原则是协调利益冲突和优化利益配置的重要方法和工具。禁止权利滥用原则实为诚实信用、公序良俗、公平、合法等民法基本原则的下位原则，是有关权利行使方面的具体原则，为以上民法基本原则所包容。关于权利滥用的构成要件应采主客观相结合主义观点；关于权利滥用的具体法律后果可区分权利滥用的不同表现情形而分别予以分析。
