影视作品网络著作权侵权法定赔偿额研究——以310例判决为样本

影视作品的网络著作权纠纷在2008年后大量出现。但由于举证困难,法院判定侵权成立后,常会适用法定赔偿以弥补著作权人的损失。因此,本文采用一种类型化的研究方法,以310例判决为样本,分别从法官进行法定赔偿所考量的因素,以及最终赔偿额两个方面认论证法官适用法定赔偿具有制度稳定性,也可以使当事人实现制度预期。并在最后部分提出提升制度预期的若干建议。
