以报应为观念基础的刑事司法程序,以揭露和惩罚犯罪为主要目的,因而被赋予以证据揭示已然犯罪事实、公正分配刑罚责任的主要功能;以宽恕为观念基础的恢复性少年司法,则以促进罪错少年康复,即回归健康成长之路为目的,因此,需要被赋予以证据揭示已然和未然罪错事实、公正分配道义和法律责任,修复受罪错损害的社会关系的功能。

On the Orientation of Juvenile Judicial System with Chinese Characteristics

The criminal judicial system,based on the principle of retribution,is mainly to reveal crimes and punish the involving criminals,which,therefore,is given the main functions of revealing the happened crimes and justly allotting the liability of penalty.Nevertheless,the restorative juvenile judicial system,based on the notion of clemency and rehabilitation,is to help the delinquent teenagers to be back on the path of healthy growth.Thus,it should be given the function of revealing both the happened and possible crimes,justly allotting the moral and legal liabilities and repairing the social relationships that have been damaged by the delinquencies.
