| 摘 要： | 本文分四个方面探讨了刑法第93条规定的国家工作人员的认定问题:一是在国家机关中从事公务的人员,二是国有公司、企业、事业单位、人民团体中从事公务的人员,三是国家机关、国有公司、企业、事业单位、人民团体委托管理、经营国有财产的人员,四是其他依照法律从事公务的人员。

| Abstract: | )Abstrsct:This paper discusses the problem on how to identify state functionary specified by the 93rd provision of Penal Law from four aspects.First of all,they are the personnel of government offices who are engaged in government affairs;secondly,they include the staff of state-owned corporation,enterprise,institution and mass organization who are engaged in official business;the third group refers to those people who are entrusted by state-owned corporation,enterprise,institution and mass organization with managing and running state-owned property;and the fourth is other personnel engaged in official business according to laws. |
