发展权的演变与实现途径——略论发展中国家争取发展的人权

发展权是发展中国家提出的新的法律概念，是新旧国际经济秩序斗争的产物。发展权不仅仅是一项人权，而且是一项集体人权，是民族自决权的必然延伸，其核心是经济发展。随着发展权概念的发展，发展权已经超越了国际人权法的特定范围，而成为指导国际关系各个领域的一般国际法原则。发展中国家要真正实现自己的发展权，必须坚持与其他国家的国际合作，通过平等参与国际决策，建立起新的国际经济秩序。

Evolution and Realization of the Right to Development:Some Observations on the Human Rights of Developing Countries for Development

The right to development is a new legal con cept proposed by developing countries. It results from the conflict between the old international economic order and a new one. It is not only a human right of a personal kind but also on e in a collective sense being a natural extension of a nation's right of self-de termination, the core of which is development. The right to development has, thr ough its evolution, surpassed the scope of the international law of human rights and become one of the general principles of international law governing all asp ects of international relations. To realize the right to development, developing countries must persist in cooperating with other countries and establishing a n ew international economic order through equal participation in making internatio nal policy decisions.
