摘要：不能犯的可罚性问题历来是刑法理论中争议较大的问题之一。而其中的核心则在于如何理解“危险”的含义。危险不仅仅是一种引起侵害结果的事实状态，更是人们对这一状态的价值判断。应从行为人与行为两个层面，并结合刑罚的预防目的来把握不能犯中的危险含义。

The Nature of Danger in Criminal Theory

The problem of punishability of impossibility has always been the controversial one in the criminal theory. The core of the problem is how to understand the meaning of danger. The nature of danger is not only a state of fact but also a value judg- ment about the fact. We should understand the meaning of danger through two sides of the actor and the act, together with the aim of punishment in criminal law.
