从人权视角谈人民警察权

人民警察作为一支国家的武装力量,担负着保卫国家安全和维护社会治安等多项职能,对公民人权保护起着非常重要的作用.任何形式的公共权力,都存在着正确使用的问题,警察如果不能正确使用警察权,也会对人权构成一定的侵害,如刑讯逼供、超期羁押、滥用强制措施等.对人民警察进行权利观的教育,在制度层面对警察权进行必要的约束,加强对警察权的监督,对于中国公民的人权保护具有重要的意义.

Discussion on the People Policeman's Right from the Angle of Human Right

As a state armed force the people's policeman shoulders various duties such as defending the state safety, maintaining social order and plays an important role in protecting citizen's human right. But in any public power there exists the question about how correct use of it. If the policeman doesn't correctly use his power such as extorting a confession by torture, detaining with extended limit, abusing mandatory measures, etc, then the people's human right will be aggressed upon in certain extent. Therefore, it has important significance for protection of citizen's human right to educate the people's policeman with respect to the view of power, necessarily limit and supervise his power.
