| 摘 要： | 死刑问题尤其是死刑存废问题，已成为中国刑事领域的热门话题，并引起了社会大众的广泛关注。如今世界上许多国家在法律上废除了死刑或在司法实践中已不执行死刑。基于我国司法条件、司法特点、诉讼文化、诉讼传统、历史背景、社会状况等各方面的情况，以及死刑所具有的特殊功能，我国目前还不具备废除死刑的条件，但我国应从完善死刑制度着手，以严格限制死刑的适用，真正做到“少杀、慎杀”，从而顺应国际死刑制度发展的总趋势。

| Abstract: | The problem of capital punishment system,such as the existence of the capital punishment system,having become the heated issue in the Chinese penalty and a public concern.Now,in the world,many countries have abolished capital punishment on the law or have already not carried out capital punishment in practice.For the moment,in our country,as a result of the politics,economy,culture,law,history,the peculiarity functions of capital punishment and so on,it is impossible to abolish it.But the capital punishment system must be improved,be kept down severely,and be kept up with the development of the international capital punishment system. |
