| 摘 要： | 诉权赋予当事人通过司法途径保护自己的权利 ,但由于缺乏有效的诉权约束制度 ,致使滥用诉权的行为成为社会的一大公害。滥用诉权的行为违背了诉讼的诚实信用原则 ,诉讼效益要求我们有必要规制诉权的滥用。我们应该借鉴西方国家的有益经验 ,完善我国的诉权制度。

| Abstract: | The litigious right endows parties with the right to protect themselves by means of justice. But owing to the lack of litigious right restriction system, abusing litigious right becomes a severe public disaster of the society. Abusing litigious right violates the principle of honesty trustworthiness. The lawsuit efficiency requires us to use the legal restriction system to restrict the litigious right. We should refer to the helpful experience of the western nations to perfect our litigious right system. |
