婚姻——一种身份性契约——兼论“第三者责任”

婚姻关系是人类生命得以延续和社会发展的基础，保护婚姻关系有利于社会的稳定。然而，在生活中，第三者破坏他人婚姻的事件屡见不鲜，我国《婚姻法》第四十六条排除了第三者承担离婚损害赔偿责任的可能性，因而在多数情况下第三者破坏他人婚姻不用承担责任。这条规定不但不利于保护婚姻关系的稳定，而且会引发一系列的社会问题，如情杀、仇杀、离婚率的上升、单亲家庭增多等。对于破坏他人婚姻的第三者责任，在立法上应予以明确规定，以更好地保护婚姻关系、稳固家庭。

However, in reality, third party damages the marriage often. The 46th article of China＇ s Marriage Law excludes a third party＇ s divorce compensation, which leads to a third party in most cases does not bear the responsibilities for undermining others＇ marriages. There is no doubt that this is not clears responsibility for the third party damaging others＇ marriages. The third party liability should be clearly defined in the legislation, which will improve the Marriage Law of China, and protect the marriage and families stability.
