海外中国公民领事保护立法初探

近年来海外中国公民人数激增,与此同时,他们所面临的风险也日趋复杂多样。加强对海外中国公民的领事保护不仅是外交工作的重大职责,也是中国国力增强的体现。当前海外中国公民保护的主要问题是缺乏完整统一的立法,2009年11月9日《中华人民共和国领事工作条例(征求意见稿)》(简称《意见稿》)是我国进行领事保护立法的初步实践。该《意见稿》有其重要价值,也存在明显不足。顺应时代要求,更新外交观念,借鉴国外先进经验,建立健全海外中国公民领事保护立法是当前我国领事保护工作的当务之急。

A Primary Research on the Consular Protection of Chinese Citizen Overseas From the View of Consular Legislation

The number of Chinese Citizens Overseas has been increasing rapidly in recent years;meanwhile they are facing more and complicated risks.To better protect the legal rights and interests of Chinese citizens overseas is not only the duty of China's foreign affairs,but also a reflection of a country's increasing power.At present,the key problem in protecting Chinese citizens overseas is the absence of integrated and unified legislation.The Regulations of the People's Republic of China on Consular Affairs(a draft for discussion) is China's first consular legislation practice.It is of great importance,yet is still far less than providing an overall and authoritative legislation of protecting Chinese Citizens Overseas.Therefore,the top priority of China's consular protection is to improve and perfect the consular legislation of China by updating diplomatic conceptions and learning from developed countries' experience.
