数据电文收发时间的确定与我国相关立法的完善

随着电子商务的飞速发展,如何确定一项数据电文的收发时间成为电子交易中亟需解决的问题,也成为国际国内立法关注的重点。关于数据电文的收发时间的确定存在着众多不同的观点和做法,而以“脱离”发出标准和“推定”到达规则分别确定数据电文的发送与收到时间,则具有一定的合理性。我国合同法应尽快补充和完善相关规定以适应并促进我国电子商务的进一步发展。

With the fast development of electronic commerce,it has become a vital problem to be solved that how people regulate the time of dispatch and receipt of electronic communications in domestic and international legislations.As far as the data telegram text receiving and dispatching time determination is concerned,there are multitudinous different viewpoints and legislations,among which,the "leaving" dispatch standard and the "estimated" receipt regulation have more rationality.In order to promote the further development of electronic commerce,one of the most important things for China is to supplement the contract law and perfect relevant regulations.
