| 摘 要： | 甲骨文中有(道)字."道"字本义:人在超越私而天人相通、天人合一时,所明白的宇宙真谛.老子之"道"可比拟为:真道生妙无,妙无生神明,神明生理念,理念生规律,规律生万物.中国法律理想图景可从中受启迪,从"现代化范式"及其"逻各斯中心主义"向去蔽之"道"之真精神转化:在"逻辑与直观统一"精神下之法律文化,既主张法治的实现,又使西方逻各斯中心主义的理性至上与传统中国逻辑缺乏导致的主体精神缺失的毛病皆得到克服."道"包含"法自然"与"自然法"两重意境,则可通过把形上之"道"作为终极价值诉求,把更易把握之"理"作为法无明文规定时"自由裁量权"的标准,防治法律文化中现代性的弊端.
