| 摘 要： | 物权观念是整个物权法藉以建立的逻辑基础.物权观念经历了由古典绝对物权到现代相对物权的变迁.普通法系早在15世纪末就顺利地实现了这一变迁,大陆法系中的法国法系也在18世纪末产生了成熟的经由契约变动物权的相对物权思想,而德国法系的物权法则始终囿于古典的绝对物权理念.我国未来物权法应当顺应物权观念演进的历史潮流,实现由绝对物权到相对物权的历史性更新.

| Abstract: | The concept of real property is the logical basis of the whole real property law.During the history of real property law,the concept of real property has experienced a vicissitude from the classical one to the modern one.This vicissitude occurs normally in the Anglo-American legal system in about 15C,and in the France legal system in about 18C,but failed in Germany legal system.Our future real property law should comply with the historical trend of the vicissitude of real property. |
