信用证犯罪惩治规制的国际化和我国的法律对策

伴随着对外贸易额的迅猛增长,信用证犯罪在我国也日渐猖獗。信用证犯罪具有很强的跨国性或涉外性,遏制信用证犯罪要在完善国内立法的基础上,积极寻求国际合作。本文论述了信用证犯罪的国际性特征和信用证犯罪的基本手段,着重阐明了惩治规制信用证犯罪的国际标准,以此为参照,对我国如何完善立法,充分利用国际上现有的机制来惩治规制信用证犯罪提出了建议。

Internationalization of Punishing the Crime Concerning Letters of Credit and Countermeasures in China Legislation

With the rapid development of the foreign trade,the crime with the letters of credit is becoming more and more serious in China. This crime has a strong transnational or foreign-related character. To contain this crime,we should be active in seeking international cooperation.On the basis of perfecting the civil legislation,this article introduces the transnational character of the crime and its basic means.More emphasis is laid on clarifying the international standards of punishing and regulating such crime. Referring to them,the author gives some advices on how to perfect the legislation and fully utilize the existing international mechanism to penalize and regulate such crime.
