摘    要:新修改的《消费者权益保护法》构建了更为全面的惩罚性赔偿制度,加大了惩罚性赔偿的力度,扩大了其适用范围,力图更有效地保护消费者的权益。借鉴大陆法系和英美法系典型国家具有代表性的理论与案例,兼采法律的经济分析方法,对该惩罚性赔偿制度进行了理论剖析与评价。

Abstract:The new generation of migrant workers has become the main body of China' s migrant workers team. Enhancing the employment stability of the new generation of migrant workers is conducive to the integra- tion of urban and rural areas in China and to the promotion of constructing socialist harmonious society. The factors affecting the employment stability of the new generation of migrant workers are mainly as follows: the division of urban and rural household registration system and social security system; income gap in urban and rural areas, regions and industries; employment environment; employment outlook and employment opportuni- ty recognition of the new generation of migrant workers etc. By improving the quality of human capital of the new generation of migrant workers, perfecting relevant laws and regulations, bettering employment environment for them, guiding them in establishing a correct concept of employment can we promote the stable employment of them.
