| 摘 要： | 法院调解在我国民事诉讼中发挥着重要作用,但目前该制度在理论和实践中存在着一些弊端和争议。本文试图从经济学的角度,分别使用成本理论、效用理论和博弈论来论证和检验调解制度存在的必要性和可行性。
