| 摘 要： | 中国古代司法对和谐的追求从未间断、一以贯之,从而已形成一种根深蒂固的文化传统。和谐的司法制度作为我国构建和谐社会的重要目标之一,儒家法律文化的和谐理念应该成为现代和谐司法构建过程中批判和反思的对象;同时亦应承担＂反哺＂的角色,为转型期社会的道德重建和司法制度的人性化提供可鉴的本土化资源。
