| 摘 要： | 中国传统法律思想一个重要的特征就是无讼,无讼就是不通过诉讼的方式来解决纠纷和争端,是中国传统儒家思想在法律上的反映。传统法律的无讼思想具有注重人际和谐、轻视法律诉讼、重视道德教化、注重犯罪预防、重视贤人政治、轻视个体权利的特点。传统无讼思想作为我国传统法律文化的基本价值取向,对当代中国的法制现代化建设和民众的法律意识都产生了非常深远的影响。

| Abstract: | Non-litigation is an important feature of traditional Chinese legal thought,which refers to settlement of disputes and conflicts without getting involved in litigation;it is a legal reflection of Chinese traditional Confucian thoughts.The thought of non-litigation is with the features of emphasizing harmonious relationship among people but belitting legal litigation,emphasizing moral cultivation and prevention of crime,attaching importance to the politics of valueing virtuous personnel but belittling individual rights.Being the fundamental value orientation of Chinese traditional legal culture,it has greatly influenced the modernization of legal system of contemporary China and Populace's law sense. |
