论我国集体林权流转价格制度的立法完善

合理的集体林权流转价格可以促进交易双方参与林权流转的积极性,实现森林资源的优化配置。然而,目前集体林权流转实践中,还存在集体林权流转价格过低、价格随意性大、价格透明度不够等问题。从制度层面考察,集体林权流转价格法定标准缺失、森林资源资产评估制度缺陷、集体林权流转价格管理制度不完善等是产生上述问题的重要原因。为此,不仅需要健全集体林权流转价格法律规范体系,还要重点从建立集体林权流转最低限价制度,完善集体森林资源资产评估制度,健全集体林权流转价格申报公示制度等几个方面完善集体林权流转价格法律制度,以保障集体林权流转价格机制的正常运行。

The Legislative Perfection about the Pricing System of the Collective Forest Rights Transaction in China

The reasonable price of collective forest rights transaction can help to improve the participatory enthusiasm of the two dealing parties,and to achieve the optimized allocation of forestry resources.However,there are still many problems in the current practice of collective forest rights transaction,such as the too low price and the random price with poor transparency.Considering from the aspect of governing system,the absence of legal standards of the collective forest rights transaction price,defects of the system of evaluating forest resources and assets and the imperfectness of the management system of the collective forest rights transaction price are main causes of the above-mentioned problems.Therefore,in order to develop a healthy operation of the pricing mechanism,we should not only improve the regulation system of the collective forest rights transaction price,but also lay stress on creating the bottom price system of collective forest rights transaction,improving the system of evaluating forest resources and assets,and optimizing the system of notification of collective forest rights transaction price.
